Kardashian's attorney successfully asked a Los Angeles judge to dismiss their filing in court Wednesday morning, according to a court document obtained by PEOPLE.
"This is a very delicate and difficult time for both Lamar and Khloé, and the most sensible thing to do at such a time is not make any big moves and put everything on hold," a source tells PEOPLE. "So that’s what she is doing."

The reality star has been by her estranged husband's side ever since the former NBA player was found unconscious in a Nevada brothel last week and rushed to a Las Vegas hospital, where doctors detected cocaine and opiates in his system. He is now recovering at Cedars-Sinai Medical Center in L.A.
Kardashian, 31, and Odom, 35, tied the knot on national TV in September 2009. The marriage fell apart after the former basketball player's cheating scandal and drug relapse, and Kardashian filed for divorce in 2013. The stars finally both signed divorce papers in July, but because the judgement had not yet been entered in court when he was hospitalized, they remain legally married – meaning Kardashian had to make all of his medical decisions while he was in a coma for four days.
